Transparency: Making Data Use Understandable

One of GDPR’s core principles is transparency. Users must clearly understand:

• What data is being collected during the conversation

• For what purposes the data will be used

In practical terms, this means chatbots should not operate as “black boxes.” A short, clear disclosure at the start of the interaction-supported by an accessible privacy policy-is often enough. What matters is clarity, not legal complexity.

Consent Must Be Explicit, Not Assumed

GDPR sets a high bar for consent, especially in automated systems. For chatbots, this translates into several concrete requirements:

When chatbots move beyond conversation into:

• Automated recommendations with business impact

they may fall under GDPR rules for automated decision-making. In these cases, organizations must ensure:

• Decisions are explainable at a meaningful level

• Human intervention is possible when required

• Users are informed that automated processing is occurring

This is where legal, technical, and product teams must work closely together.


Common GDPR Mistakes in Chatbot Projects

Many compliance failures stem from assumptions rather than intent. Frequent issues include:

1. Believing that using an AI API transfers GDPR responsibility

2. Storing all conversations “just in case”

3. Lacking internal documentation of data flows

4. Ignoring cross-border data implications

These gaps often surface only during audits, complaints, or expansion into regulated markets.

GDPR is often framed as a limitation, but for chatbots it can be a quality benchmark. Systems built with privacy in mind tend to be:
